IN CASE OF TRANSPORTING DANGEROUS GOODS BY WATERWAY, ARE THE LICENSES EXEMPT?
From June 1st 2020, waterway vehicles transporting goods on the list of dangerous goods must have a transport permit, but some cases are exempt.
According to the Government’s Decree No. 42/2020 (stipulating the list of dangerous goods, transporting dangerous goods by road motor vehicles, inland waterway transports) hazards are classified into 9 groups (explosive and explosive products, gas, flammable liquid and desensitized liquid, toxic, radioactive …). Organizations and individuals transporting dangerous goods on the list specified in the above decree must have permits to transport dangerous goods.
Depending on the type of goods (including 9 groups), agencies granting transport permits are the Ministry of Public Security, the Ministry of Science and Technology, the Ministry of Agriculture and Rural Development. Licensing agencies shall base on the type and group of dangerous goods to decide the route and time of transportation.
Regarding the requirements for vehicles, participants in transporting dangerous goods on waterways, it is required that the means must be stuck with symbols of dangerous goods on both sides of the vehicles. Crew members working on vehicles transporting dangerous goods must be trained and have a special certificate of transport of dangerous goods in accordance with the regulations of the Minister of Transport.
Storekeepers, escorts, people loading and unloading dangerous cargoes on vehicles and at inland ports and wharves must be trained and granted certificates of completion of training programs on their dangerous goods. escorting, loading, unloading or warehousing as prescribed.
However, notably, the decree also stipulates a number of cases of transporting goods on the list of dangerous goods but not having to apply for a license to transport dangerous goods. Including: transporting dangerous goods which are liquefied natural gas (LNG) and compressed natural gas (CNG) with a total volume of less than 1,080 kg; liquefied petroleum gas (LPG) with a total volume of less than 2,250 kg; liquid fuel with a total capacity of less than 1,500 liters; Plant protection chemicals with a total volume of less than 1,000 kg.
The Decree takes effect from June 1st 2020.
